甲、乙双方就学生租房事宜的有关权利和义务,经签字或盖章确认,达成如下协议:

第一条  租赁房屋及期限

甲方将上外迎宾馆房号___室,面积___M2出租给乙方(双人房须由两名学生合租),供乙方学习期间用于住宿,租用期为___天(自_________日至_________日中午12:00止)。如需延长,乙方须于租房期届满前___天向甲方提出延期,经甲方同意后方可续租,并办理续租手续及付费。

第二条  租金标准及支付方式

乙方每天的房租为___元,该房价以学年为单位,享受价格优惠,租金按学期为单位收

第三条  甲方保洁义务

甲方每周一次为乙方更换床上用品清扫房间确保清扫质量符合基本居住卫生标准

第四条  甲方配套服务义务

甲方为乙方提供24小时热水,根据季节气候变化合理提供中央空调服务,确保设备正常运行,保证乙方基本居住需求

第五条  房内设施使用及赔偿

甲方提供乙方免费使用房内设施:床、床头柜、电视机、写字台、饮水机、电话机、路由器及网线乙方入住时,应核对设施完好状态,如未在入住时提出异议,视为房内设施齐全及符合正常使用状态。租赁期间,因乙方故意或重大过失造成设施损坏,乙方要照价赔偿。

第六条  公共区域设施及服务

甲方在413楼层的公共区域内为乙方提供处于正常使用状态的电冰箱、电磁灶、微波炉,并有偿提供洗衣机(3/)和衣物烘干机(4/小时)服务。收费标准若需调整,甲方应提前3天告知乙方。

第七条  桶装水服务

甲方为乙方有偿提供桶装水,乙方若需使用,请到总台购买水票(18/张),凭水票和空桶到房务中心(320房间)换取。

第八条  增值服务约定

甲方为乙方有偿提供衣物送洗、熨烫,行李寄存等服务,乙方若需使用,可到房务中心办理(内线电话:85)。寄存行李时乙方需出示预订单,寄存期限为最长不超过三个月若乙方因特殊情况需延长寄存期限,应提前3天书面告知甲方并获得同意;逾期未领取且未书面说明特殊情况的,甲方应先以书面形式(包括微信及短信方式)通知乙方,通知后超过10天乙方仍未领取的,甲方可将乙方存放物品放弃物处理。

第九条  复印传真服务

甲方为乙方有偿提供复印、传真服务乙方若使用,可前台咨询(内线电话:81)。

第十条  贵重物品寄存服务

甲方为乙方有偿提供贵重物品寄存保管服务双方应明确寄存物品名称、数量、价值及保管期限,签订寄存协议,甲方对保管期间的物品毁损、灭失(因不可抗力、乙方自身过错除外)承担赔偿责任

甲方有权拒绝寄存可能对人身及财产存在不安全因素的物品,不安全因素以甲方判断为准。

第十一条  设施维修义务

租赁期间,房内设施因正常使用产生的损坏,甲方应在乙方报修后给予及时维修和更换。

第十二条  房屋使用限制

为充分发挥房间使用率,以及作为学生住宿用房的特殊性,乙方服从甲方的分房安排,如双人房中的一人退房,造成空床现象甲方可做出拼房安排,乙方须服从甲方的拼房安排。未经甲方许可,乙方不得私自转让出借租赁房间若乙方违反该约定,公费生取消公费住宿迎宾馆的资格,自费生按迎宾馆有关规定予以处理

 

第十三条  定金、押金及租金支付

乙方在签订本合同时,须支付单人间预定金2000元,双人间预定金1000元,入住时一次性支付全部租金,包括住房押金500元。预定金可抵扣入住后的租金或押金。乙方预定后不按期入住,给甲方造成经济损失的,甲方可扣除预定金作为赔偿甲方可按照实际经济损失对预定金作多退少补的处理租赁期满,乙方无违约行为且房屋设施完好的,甲方应在退房后7日内退还押金。

第十四条  退房及物品处理

根据学校教学规定,学生从_________日报到注册开学至_________日止,共计___学生用房有周期性强、房源需提前预留等特殊性,乙方因个人原因在学期中途提出退房则视为违约,甲方房间空置、行政成本增加损失由乙方承担。双方可根据实际情况协商赔偿,赔偿金额从剩余租金中扣除;协商不成的,按本协议约定执行。

退房时,乙方应清理个人物品,遗留物品甲方应妥善保管,同时以书面形式(包括微信及短信方式)通知乙方,通知后超过10天乙方仍未领取的,甲方可将乙方遗留物品放弃物处理。

第十五条  自购冰箱使用约定

入住迎宾馆413楼层的学生,如需在房内使用自购电冰箱,需在使用前向总台申请,经甲方同意后,每月30/支付电费一学期一次性付款120/

迎宾馆提供限量租赁冰箱服务,一学期300/台。

第十六条  房屋及公共财物爱护义务

乙方爱护甲方的公共财物,严禁在房内墙上乱涂、乱画、乱粘贴,不得向窗外及走廊里乱扔垃圾,严禁在公共区域内堆放私人物品或将公共区域内的公共物品私自挪动,若因乙方故意或重大过失造成公物损坏或挪动,导致甲方经济损失的,乙方要按价赔偿。

乙方应自觉遵守与执行201971日起上海市正式实施《上海市生活垃圾管理条例》及甲方相关垃圾分类规定

第十七条    安全及管理制度遵守

乙方要自觉遵守甲方的各项规章制度,出门时关窗、锁门,确认锁定之后方可离开。乙方在房内严禁留客留宿,访客必须在当晚22点之前离开房间;房内严禁赌博、酗酒严禁携带禽畜和其它有碍卫生的物品进入房间。一经发现乙方违反的,依据《中华人民共和国治安管理处罚法》第五十七条由相关部门处罚 

第十八条  消防安全约定

根据上海市公安局与消防部门的有关规定,乙方在入住期间,房内禁止使用电炉、电热杯、电熨斗、电热毯、取暖器、电加热、电磁炉、电烤箱、微波炉等电器设备,严禁在建筑物内(含房间、公共区域)为电瓶(含电动自行车、蓄电池等)充电。一经发现,甲方可予以暂扣、责令乙方整改;若乙方拒不整改或造成安全隐患、事故的,甲方可解除租赁合同并追究乙方法律责任情节严重的,移交公安机关处理。

如遇房内电器设备出现故障,乙方应及时报修,甲方给予及时维修。如发生盗窃或者火警时应及时报告安保(内线电话:3102)或总台(81)。

第十九条  房卡及收费收据保管

乙方应妥善保管好收费原始收据和房卡。如遇房卡遗失或损坏,应立即报告总台,由甲方负责重新设置芯片,乙方须赔偿20元。乙方不得擅自将房卡借给他人,发现此类情况,甲方可依据法律及甲方规章制度追究乙方责任。(注:请在离开房间时拔出房卡,切断房间电源。)

第二十条  争议解决及法律适用

本合同未尽事宜或在履行过程中发生争议,甲乙双方应友好协商解决,协商不成的,可提请见证方(丙方)协调解决也可乙方向房屋所在地人民法院提起诉讼。

本合同为中英文版本,内容若有不一致以中文版本为准,

本合同适用中华人民共和国法律管辖。

第二十一条  合同生效及其它

本合同一式三份甲乙双方签字或盖章后生效。

Party A and Party B, on matters relating to the rights and obligations of rental, confirmed by the signature or stamp, reach the following agreement:

Article 1: The Leased Room and Lease Term

Party A will lease Room No.      at SISU Guesthouse to Party B (a double room is to be shared by two students), for Party B to use it for accommodation when studying, and the lease period is ____days [from___ (month) ___ (day) , 20___ to the noon (12:00) of       (month) ___(day), 20___ . If any extension is needed, Party B shall request it ___ days prior to the expiration of the lease term, and only with Party A's consent may Party B extend the lease, go through the lease extension formalities and make payments.

Article 2: Rent Standards and Payment Method 

Party B’s daily rent is RMB      , which is a preferential price offered in view of the Party B’s use of the room for a whole academic year. The rent is payable by semester.

Article 3: Party As Cleaning Obligation

Party A will replace the bedding and clean the room once a week for Party B, and ensure that the cleaning quality meets basic living sanitation standards.

Article 4: Party As Supporting Service Obligation

Party A will supply hot water round the clock for Party B and reasonably provide centralized air conditioning according to the seasonal climate change, ensuring that related equipment function normally, and meet basic living needs of Party B.

Article 5: Using of Room Facilities and Damage Compensation

The free room facilities which Party A will provide Party B with include: bed, bedside table, TV, desk, drinking water dispenser, telephone, router and Ethernet cable. When Party B checks in, he/she shall check if all such facilities are well-functioning. If no complaint is received upon check-in, Party A shall regard all room facilities as in place and normally functioning. If any of such facilities is damaged intentionally or due to the significant fault by Party B during the lease term, Party B shall be liable for compensation according to actual cost.

Article 6: Facility and Service in the Public Area

Party A will provide Party B with the use of normally functioning refrigerator, electric induction cooker and microwave oven in designated public areas on floors 4-13, while paid laundry self-service - clothes washing and drying - will be available at the price of RMB 3 each time for washing machines and RMB 4/hour for drying machines. Should there be any price adjustment, Party A shall notify Party B 3 days in advance. 

Article 7: Barreled Water Service

Party A will provide Party B with barreled water for a price. Party B shall go to the front desk to purchase water vouchers (at RMB 18 per voucher) which needs to be accompanied by empty barrels to exchange for barreled water at the Room Service Center (Room 320).

Article 8: Agreements on Value-added Service

Party A will provide Party B with the services of delivering clothing for laundry, ironing and luggage deposit, etc. for a price. Party B may go to the Room Service Center in case of need (telephone extension: 85). Party B shall show his/her booking when deposit its luggage and the maximum period of storage is three months, unless under special circumstances informed to Party A by Party B 3 days in advance and consented to by Party A. If no special circumstance is informed in writing, and if deposited items are not collected within the time limit, Party A will first notify Party B in writing (including via WeChat and text message). If Party B still fail to collect the deposited items within 10 days after the notification, Party A will treat the deposited items as discarded by Party B.

Article 9: Photocopy and Fax Service

Party A will provide Party B with photocopying and faxing services. Party B may go to the front desk in case of need (telephone extension: 81).

Article 10: Depositing of Valuables

Party A will provide Party B with valuables deposit service for a price. Both parties shall clarify the name, amount, value and deposit term of the deposited items and sign a deposit agreement. Party A shall assume compensation liability for damage or loss of the deposited items, unless such damage or loss are due to force majeure or Partys B own fault.

Party A has the right to reject the depositing of items that may pose hazard on personal or property safety, and whether such hazard exists is subject to Party As sole discretion.

Article 11: Facility Maintenance Obligation

If there is any damage from normal use to the facilities in the room during the lease term, Party A shall carry out timely maintenance or replacement for Party B upon reporting.

Article 12: Limitations to Room Using

To maximize room occupancy rate, and considering the special nature of accommodation for students, Party B shall comply with Party A’s room sharing arrangements. If one of the roommates checks out and there is a vacant bed in the double room, Party B must follow the Party A’s roommate reassigning arrangement. Without the permission of Party A, Party B may not transfer or sub-lease the room or bed. If Party B, as a government-sponsored student, transfers or sub-leases the room or bed without due authorization, he or she may be deprived of the entitlement to the accommodation in Party A at a government-sponsored price. For self-financed students, he or she may be punished according to the relevant rules of Party A for such misconduct. 

Article 13: Payment of Advance, Deposit, and Rent

When signing this contract, Party B shall make an advance reservation payment of RMB 2,000 for a single room and RMB 1,000 for a double room. Full rent (including a room deposit of RMB 500) shall be paid up in lump-sum at the time of check-in and the reservation advance may be used to offset the rent or deposit after check-in. If Party B fails to check-in on time after reservation, causing financial loss to Party A, the reservation advance will be used to indemnify Party A for such financial loss caused to . Based on the actual financial loss caused, excessive part of the reservation advance will be refunded while deficiency has to be made up for. Upon the expiry of the lease term, if Party B committed no default and kept the room facilities well-functioning, Party A shall refund the deposit within 7 days after checking-out.

Article 14: Check-out and Disposal of Belongings

According to SISU s regulations, the student shall register for enrolment from ___(month) ___(day), 20___ and the semester will last until ___(month) ___(day), 20___ , totaling _____ days. Due to the special nature of student housing, such as strong cyclical nature and the need to reserve rooms in advance, if Party B requests to terminate the lease and move out in the middle of a semester for personal reasons, the termination shall be deemed as breaching the contract. Party B shall bear the loss of Party A as a result of room vacancy and additional administrative costs. Both parties may negotiate compensation based on the actual circumstances, and the compensation amount shall be deducted from the balance of rent paid. If no agreement can be reached through negotiation, the provisions of this agreement shall apply.

When checking out, Party B shall remove all personal belongings. Any item left behind shall be properly kept by Party A, who shall notify Party B in writing (including via WeChat or text messages). If Party B fails to collect the items within 10 days after such notice, Party A may treat the items left behind by Party B as abandoned.

Article 15: Agreement on Using Self-purchased Refrigerator

If Party B living on floors 4-13 need to use a self-purchased refrigerator in the room, he/she must apply to the front desk beforehand, and after obtaining Party As approval, he/she shall pay RMB 30/month/refrigerator for electricity, in the form of a lump-sum payment of RMB 120/semester for each refrigerator.

Party A provides limited refrigerator rental service at RMB 300 per unit/semester.

Article 16: Obligation of Caring for Rooms and Public Property

Party B shall take good care of Party A’s public property; it is strictly prohibited to scrawl graffiti, draw pictures or attach things on the walls in the room; it is strictly prohibited to throw garbage out of the windows or in the corridors; it is strictly prohibited to store personal belongings in public areas or move the public property in public areas. In case of any damage to the public property or any moving of public properties caused by Party B, whether such misconducts are intentional or caused by significant negligence, thus causing Party A economic losses, Party B shall compensate Party A according to the actual price of such properties.

Party B shall abide by and act in accordance with Regulations on Administration of Domestic Garbage of Shanghai which has been implemented since July 1, 2019, as well as garbage classification rules of Party A.

Article 17: Compliance with Safety and Administration Systems

Party B shall abide by Party A's rules and regulations conscientiously; Party B shall shut the window and lock the door and check if the door has been properly locked before leaving the room; it is strictly forbidden for Party B to let any visitor stay in the room overnight; visitors must leave before 22:00; It is strictly prohibited to be engaged in gambling, alcohol drinking, bringing poultry and other animals, or any other things with a health concern into the room. Once violation is caught, the person involved shall be handed over to related authorities to be punished according to Article 57 of The Law of the People’s Republic of China on Penalties for Administration of Public Security.

Article 18: Fire Safety Agreements

According to the relevant provisions of Shanghai Public Security Bureau and Firefighting Department, Party B, when living in the leased room, is prohibited to use electric appliances such as electric stove, electric cup, electric iron, electric blanket, electric warmer, electric water heater, electric induction stove, electric oven, and microwave oven in the room. Charging batteries (including those of electric bicycles, storage batteries, etc.) inside the building (including rooms and common areas) is strictly prohibited. If such misconduct is discovered, Party A may temporarily confiscate the related items and order Party B to make corrections. If Party B refuses to rectify the situation or causes safety hazards or accidents, Party A may terminate the lease agreement and hold Party B legally liable. In serious cases, the matter may be referred to the public security authorities for handling.

In the event of a malfunction of electrical appliances or equipment in the room, Party B shall promptly report the situation for repair, and Party A shall arrange timely maintenance. In the event of theft or fire, Party B shall promptly report to the Security Department (telephone extension: 3102) or the Front Desk (telephone extension: 81).

Article 19: Preservation of Room Card and Payment Receipts

Party B should properly keep the original payment receipts and the room card. In case a room card is lost or damaged, Party B shall report to the front desk immediately; Party A shall reset the card chip and Party B shall pay RMB 20 for such lost or damaged room card as a compensation. Party B may not lend the room card to others without authorization, otherwise, Party B will be held accountable for such behavior in accordance with the law and Party As rules and regulations. (Please remove the room card from the socket when you leave the room in order to shut down power supply for the room.)

Article 20: Dispute Resolution and Governing Laws

Matters not covered in this contract or any dispute arising from the performance of this contract shall be settled through friendly negotiations between Party A and Party B. Should such negotiations fail, such disputes may be referred to the witnessing party (Party C) for reconciliation, or a lawsuit may be launched by Party B to the Peoples Court where the housing is located.

This contract is prepared in both Chinese and English. In the event of any inconsistency, the Chinese version shall prevail.

This contract shall be governed by the laws of the People's Republic of China.

Article 21: The effectiveness of the Contract and Miscellaneous Provisions

This contract is made in triplicate, and will take effect upon the signatures or stamps of the parties hereto.
